Reserved Powers Trusts

There are many reasons why a person may wish to reserve specific powers and in doing so, allow them a greater degree of control over the management of the trust fund.

In situations where there is a family business and he or she wishes to stay involved in the decision making process, it may be appropriate to retain certain powers. There may be situations where they wish to retain specific powers that would enable them to direct the trustee as to the investment of the trust fund. However, the extent to which powers can be reserved is dependent on the settlor's residence and personal circumstances.
